THE US JUSTICE department has dispatched six attorneys to support AIDS
activists in their lawsuit against Dr. Randon Bragdon,
a family dentist in Bangor, Maine. Dr. Bragdon's crime?
He agreed to treat a female patient who identified
herself as HIV-positive, but insisted the treatment be
carried out in a local hospital, not his office. Dr.
Bragdon felt the hospital treatment would be safer for
the patient, his staff, and his other patients. The
patient has sued Dr. Bragdon in federal court under the
Americans with Disabilities Act, claiming the treatment
would cost her more in a hospital, and is therefore
discriminatory. The trial begins 10 October 1995.

ANALYSIS & COMMENTARY: In addition to six US Justice Department
attorneys, both the Maine Human Rights Commission and GLAD (Gays,
Lesbians, Advocates and Defenders in Boston) have joined the case
(Sidney Abbott v. Randon Bragdon, DMD.)
DR. BRAGDON'S PATIENTS, mindful of the fate of Kimberly Bergalis (who
died of AIDS after being infected by Florida dentist Dr. David Acer),
have formed a Patients Association. They argue that they do not have
AIDS, and do not wish to be exposed to the HIV virus, which causes
AIDS.
THE US JUSTICE department, it would appear, has once again come out
against most Americans, in favor of the politically correct minority.
Rather than support the common-sense desire of healthy persons to
avoid exposure to a deadly disease, the Clinton Administration is
attempting to mandate, at the point of a gun, the mindless policy of
insuring that as many Americans as possible are exposed to a disease
for which there is no cure.
IN THE PROCESS, the Justice Department is willing to destroy doctors,
patients, and anyone else who gets in their way. Their chosen vehicle
this time is the Americans with Disabilities Act and crushing legal
fees: There is simply no other way to describe the full force of the
federal government brought to bear against a single dentist over the
issue of what constitutes safe medical treatment for a patient.
WHILE DR. BRAGDON'S legal fees are covered by his insurance, those of
his patients are not The patients are being assisted by the Maine
Christian Legal Defense Fund, POB 116, So. Gardiner ME 04359. They
seek to raise $30,000 to cover legal expenses. Tax-deductible
contributions may be directed to Rev. Stuart Hilton, Treasurer.
BECAUSE THE PATIENT has asked for monetary damages, the trial will be
before a jury, something the Americans with Disabilities Act was
designed to avoid. Dr. Bragdon's attorney is Lewis Kornreich, POB 917,
